EU court to rule on appeal over agricultural imports from Western Sahara in early October

On October 4, the Court of Justice of the European Union (CJEU) is expected to announce its decision regarding an appeal from the French Confédération Paysanne against the French government’s authorization of agricultural imports from Western Sahara.

The focus of the appeal centers on tomatoes and melons.

In a non-binding opinion issued on March 21, Advocate General Tamara Ćapeta called for these products to be labeled with their true origin, stating, “Melons and tomatoes from the territory of Western Sahara must be labeled with a ‘country of origin’ indication reflecting their provenance from that territory.” This stance was welcomed by the Polisario Front.

However, Ćapeta clarified that EU regulations do not permit the French government to impose a unilateral import ban solely due to incorrect labeling of these products. The CJEU has yet to set a date for its ruling on the EU’s appeal to overturn a previous decision from September 29, 2021, which largely favored the Polisario.
